Our client had 282 infringement warrants totalling over $80,000. Two hundred and forty-six of those infringements were for toll offences with the remainder consisting of police matters. Our client had suffered from depression during the period in which the infringements were accrued. His marriage had fallen apart and there was a bitter custody dispute over the children, and he had not been able to cope.
The case was heard at the Sunshine Magistrates’ Court.
We made an application for discharge under s 160 of the Infringements. Our client gave evidence and a short psychological report was tendered. Following submissions, her Honour discharged the client of all 246 toll infringement warrants and put the client on a payment plan for the remainder.
